4. User Content and Data
You retain full ownership of all data you input into the App, including habits, goals, fitness data, and images.
- ALL your data is stored locally on your device only
- NO data is stored on our servers
- You have 100% control and ownership of your data
- You can delete your data at any time by uninstalling the App
- Face images are processed and stored locally only
- We cannot access, view, or retrieve your personal data
5. AI-Powered Features
Orbit uses artificial intelligence to provide features such as calorie estimation and self-improvement insights. Please note:
- AI-generated content is provided for informational purposes only
- Results may not always be accurate and should not replace professional advice
- We do not guarantee the accuracy, completeness, or reliability of AI outputs
- AI inputs are processed securely and not used for advertising
6. Health and Fitness Disclaimer
Orbit is NOT a substitute for professional medical, nutritional, or fitness advice. The App provides general information and tracking tools only. You should:
- Consult a healthcare professional before starting any new diet or exercise program
- Not rely solely on the App for medical decisions
- Seek immediate medical attention for any serious health concerns
- Understand that calorie estimates and fitness recommendations are approximations
We are not liable for any health issues, injuries, or consequences arising from your use of the App.
7. Third-Party Services
Orbit integrates with third-party services (such as OpenAI API) to provide certain features. When you use AI-powered features:
- Only the necessary input is sent temporarily to the third-party service for processing
- Results are returned and stored locally on your device
- We do not store any inputs or outputs on our servers
- Third-party services have their own terms and privacy policies
We are not responsible for the practices or content of third-party services.
8. Prohibited Conduct
You agree not to:
- Use the App to harm, harass, or violate the rights of others
- Upload malicious code, viruses, or harmful content
- Interfere with or disrupt the App's functionality
- Use automated systems (bots, scrapers) to access the App
- Impersonate any person or entity
- Violate any applicable laws or regulations
9. Intellectual Property
All content, features, and functionality of Orbit, including but not limited to text, graphics, logos, icons, images, and software, are the property of Orbit and are protected by copyright, trademark, and other intellectual property laws.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your license to use the App will immediately cease.
Note: Since all data is stored locally on your device, uninstalling the App will permanently delete all your data. We cannot recover your data as we do not store it on our servers.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that:
- The App will be uninterrupted, secure, or error-free
- Results or information will be accurate or reliable
- Defects will be corrected
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORBIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, profits, or revenue
- Personal injury or health issues
- Interruption of business
- Loss of goodwill
Our total liability shall not exceed the amount you paid to use the App (if applicable).
13. Indemnification
You agree to indemnify and hold harmless Orbit, its developers, and affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App or on our website. Your continued use of the App after changes constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Orbit operates, without regard to conflict of law principles.
16. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class-action lawsuits.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Orbit regarding your use of the App.
